These Terms and Conditions (“Terms”) govern your access to and use of the Filterly Service. By registering an account or using the Service, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using Filterly (“the Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. If you're using Filterly on behalf of an organization, you represent you have authority to bind it.
You must be at least 13 years old (or the minimum legal age in your country). If under 18, you must have parental consent.
2. Account Registration and Security
- Provide accurate information when registering.
- You're responsible for safeguarding your credentials.
- Creating multiple accounts to abuse the system is prohibited.
- OAuth login (e.g., Google or X/Twitter) is allowed. We aren't responsible if third-party login services become unavailable.
3. The Service and Credits System
- Filterly operates on a credit-based system.
- Free credits may be granted at sign-up.
- You can purchase additional credits.
- Credits are non-transferable and non-refundable (unless required by law).
- Paid credits don't expire while your account is active; free/ promotional ones may.
- Prices may change with prior notice. New purchases follow new prices.
4. Payment Terms
- Payments are processed by third-party processors (e.g., Stripe).
- You're responsible for applicable taxes.
- Receipts/invoices are provided upon purchase.
- Refunds are not guaranteed, but may be granted in cases of technical error.
- Failed payments may result in account suspension.
- Promotions and free trials may be offered at Filterly's discretion.
5. User Content and Data Use
- You retain ownership of your content.
- You grant Filterly a license to process it to operate the Service.
- You're responsible for content legality and permissions.
- You must not upload prohibited or illegal content.
- Integration with third-party accounts (e.g., Google, X) must follow their terms.
- Content can be processed via third-party AI providers (e.g., OpenAI, Google Gemini).
- Filterly adheres to Google's Limited Use Policy.
- Feedback you provide can be used freely by Filterly.
6. Acceptable Use and Conduct
You must not:
- Use the Service for illegal purposes.
- Attempt unauthorized access.
- Introduce harmful software.
- Exploit or resell the Service.
- Upload objectionable or unauthorized content.
- Spam or misuse AI-generated outputs.
- Reverse engineer the platform.
- Exceed fair usage limits.
Violations may result in account termination and legal action.
7. Intellectual Property Rights
- Filterly retains all rights to the platform, design, algorithms, and outputs.
- You receive a limited license to use the Service.
- You may not reproduce or modify the Service.
- Third-party content remains property of its respective owners.
- Your trademarks/logos will not be used publicly without your consent.
- Feedback you submit may be used without compensation.
8. Term and Termination
- You can delete your account anytime.
- Filterly may suspend/terminate your account for violation of Terms, failed payments, or service discontinuation.
- Upon termination, access ends and content may be deleted.
- No refund of unused credits unless legally required.
- Terms such as IP, disclaimers, and liability limits survive termination.
9. Disclaimers of Warranties
The Service is provided "as is" and "as available." Filterly disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Filterly does not guarantee:
- That the Service will meet your expectations.
- That it will be uninterrupted or error-free.
- That AI outputs are accurate or suitable.
- That errors will be corrected.
10. Limitation of Liability
Filterly shall not be liable for:
- Indirect or consequential damages.
- Loss of data, profits, or goodwill.
- Service interruptions or bugs.
- Issues with third-party providers.
Total liability is capped at the greater of:
- Amount paid in the past 12 months, or
- $100 USD.
11. Indemnification
You agree to indemnify Filterly against claims resulting from:
- Your use of the Service.
- Your violation of Terms or law.
- Your infringement on others' rights.
- Your disputes with third parties.
Filterly may assume defense at its expense.
12. Changes to These Terms
We may update these Terms with prior notice for material changes. Continued use after changes implies acceptance. Minor edits may not be individually announced.
13. Data Deletion
You may request deletion of your data anytime via support or account settings. We'll delete it unless retention is legally required.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of [Your Country/State]. You consent to jurisdiction there. EU consumers may access local courts or use the EU ODR platform.
15. Miscellaneous
- These Terms, including the Privacy Policy, form the entire agreement.
- Invalid provisions do not affect the rest.
- No waiver unless in writing.
- You may not assign your rights without consent.
- These Terms do not establish any partnership or employment.
- Legal notices may be sent to your account email.
- Filterly isn't liable for force majeure events.
